Where can Conceal Carry Weapons (CCW) holders carry in New Jersey?

4(a) and (b): Liability Insurance Requirement

Under Chapter 131 of New Jersey’s laws, there was previously a requirement for CCW holders to obtain liability insurance. However, this requirement was enjoined under Judge Bumb’s ruling on May 16, 2023. This means that the insurance requirement has been nullified, and there is no longer an insurance requirement in place. While it is not required, we recommend that every CCW holder obtain insurance as it is better to be safe than sorry.

7(a)(20): An Airport

PARTIAL – The Court clarified that Chapter 131 does not prohibit carry while dropping off or picking up passengers at curbside. The Court also ruled that while the preliminary injunction (PI) is in effect, individuals may check a firearm as checked luggage while traveling pursuant to federal law, as long as the individual stores the firearm as required by federal law before physically entering the airport and upon entry immediately proceeds to the required area to check the baggage containing the firearm. The individual cannot travel to any other section of the airport until the bag containing the firearm is checked. The Court did not rule on whether a person may carry inside any portion of the airport, and, other than the foregoing, the prohibition of carrying a firearm in an airport remains in effect. The Court did not issue an injunction as to transportation hubs and therefore that prohibition remains in effect​ (Bearing Arms)​​ (Reason.com)​.

7(a)(23): A Public Location Being Used for Making Motion Picture or Television Images

The prohibition on carrying firearms at a public location being used for making motion picture or television images for theatrical, commercial, or educational purposes during the time such location is being used for that purpose remains in effect. There has been no change or injunction issued by the Court in this regard​ (Bearing Arms)​​ (News2A)​.

7(a)(24): Private Property

The injunction only applies to private property “held open to the public.” This means that the prohibition of carrying a firearm on private property without express consent or signage indicating permissibility does not apply to residential property or commercial property not open to the public. Therefore, the injunction applies to private property where the public may enter without seeking express permission, such as retail businesses​ (News2A)​​ (Reason.com)​.

7(b)(1): Prohibition on Carrying a Loaded Firearm in a Vehicle

Judge Bumb’s ruling maintains the prohibition on carrying a loaded firearm in a vehicle. This section was not enjoined, meaning the prohibition remains in full effect as part of Chapter 131​ (Bearing Arms)​​ (Reason.com)​.

7(a)(2): Courthouse (prohibition remains in effect).

7(a)(3): Correctional facility (prohibition remains in effect).

7(a)(4): State contracted half-way house (prohibition remains in effect).

7(a)(5): Polling place (prohibition remains in effect).

7(a)(6): Within 100 feet of a place for public gatherings (prohibition remains in effect).

7(a)(7): School, college, university, or other educational institution (prohibition remains in effect).

7(a)(8): Child care facility (prohibition remains in effect).

7(a)(9): Nursery school, pre-school, summer camp (prohibition remains in effect, excluding zoos).

7(a)(10): Playground (prohibition remains in effect for playgrounds).

7(a)(11): Youth sports events (prohibition remains in effect).

7(a)(12): Library and museum (prohibition remains in effect).

7(a)(13): Homeless shelter (prohibition remains in effect).

7(a)(14): Licensed community residence for disabled terminally ill, etc. (prohibition remains in effect).

7(a)(15): Restaurant or bar (prohibition remains in effect).

7(a)(16): Cannabis retailer or dispensary (prohibition remains in effect).

7(a)(17): Entertainment venues (prohibition remains in effect).

7(a)(18): Casino and related facilities (prohibition remains in effect).

7(a)(19): Energy plant (prohibition remains in effect).

7(a)(20): Airport (prohibition remains, except for curbside drop off/pickup and air travel pursuant to federal law) and transportation hub (prohibition remains).

7(a)(21): Healthcare facility (prohibition remains for all categories except medical office and ambulatory care facility).

7(a)(22): Addiction or mental health treatment facility (prohibition remains in effect).

N.J.A.C. 13:69D–1.13: Within a casino or casino simulcasting facility (prohibition remains in effect).
